A watching service monitors the trade mark Register for applications that may conflict with your brand.  This gives you the opportunity to object to the use and registration of that trade mark on the basis of your earlier trade mark rights.

 

HallMark IP can arrange for watches to be set up, at significant discounts to rates normally offered to individual brand owners, in all trade mark jurisdictions around the world and will advise you on the best watching strategy for your brand. 

 

In addition, all trade marks filed by HallMark IP are automatically placed on a free worldwide watching service upon registration.  This operates up to the end of the calendar year in which the mark was registered. 

 

Details of all potentially conflicting trade mark applications filed in the territories being watched are issued to your HallMark IP attorney who will filter the notices received and forward to you only those that they believe may genuinely come into conflict with your mark.  If any of these marks are of concern you can contact your attorney for further advice. 

 

Similar marks are reported in the classes of interest to you and identical marks are reported in all 45 classes of the International Classification System.
